Pipe Network End User License Agreement and Terms of Service

1. Introduction
Please read this End User License Agreement and Terms of Service (“EULA” or “Terms”) carefully and retain a copy for your reference. Specific terms or conditions may apply to users in certain jurisdictions. For information on how we collect, use, share, and process your data, please refer to our Privacy Policy, available at privacy.html.
2. Agreement to Terms
This EULA is a binding agreement between you, an individual user or site visitor, whether personally or on behalf of an entity (“user,” “you,” “your”), and Pipe Foundation, a registered entity in the Cayman Islands (“Pipe,” “we,” “us,” or “our”), governing your use of Pipe Foundation’s services, including the pipe.network website, related media forms, media channels, software applications, extensions, connectors, and any other products or services provided by Pipe Foundation (collectively, the “Service”).
By downloading, accessing, viewing, or otherwise using any portion of the Service, you confirm that you have read, understood, and agree to be bound by this EULA. If you do not agree, please do not use the Service.
Supplemental terms or documents may be posted on the Site from time to time and are hereby incorporated by reference. Pipe reserves the right, in its sole discretion, to modify this EULA at any time. Changes will be reflected by updating the “Last Updated” date, and your continued use of the Service constitutes your acceptance of the revised EULA.
3. Eligibility
The Service is intended for users who are at least 18 years old. By using the Site and Service, you confirm that you are either at least 18 years of age or using the Service under the supervision of a parent or guardian who agrees to this EULA. If you are a parent or legal guardian of a user under the age of 18, you accept full responsibility for the acts or omissions of such user in relation to the Service.
Users located in restricted regions, including Cuba, Iran, North Korea, Syria, Afghanistan, Belarus, Nicaragua, Russia, Somalia, Venezuela, Yemen, and specified areas of Ukraine (Crimea, Donetsk, Luhansk, Kherson, and Zaporizhia), are prohibited from accessing or using the Service. By using the Service, you confirm that you are not in any of these restricted jurisdictions and are not listed on any applicable sanctions list.
4. User Accounts
You acknowledge that you do not own your user account on Pipe Network, nor do you have rights to any data stored on Pipe’s servers. Pipe reserves the right to manage, modify, or delete any user data at its discretion, without notice or liability.
5. Account Creation and Security
To create an account, you must provide a valid email address and keep it up to date. You are responsible for all actions taken using your account, even if you did not authorize them. If you believe your account has been compromised, you should notify Pipe immediately at [email protected].
6. Content Ownership and Restrictions
All content on the Service, including text, images, software, and other materials, is owned or licensed by Pipe and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, alter, embed, or create derivative works from any content on the Site without express written permission from Pipe.
7. Scope of License
The Service is licensed, not sold, to you, and is to be used only under the terms of this EULA. Pipe grants you a personal, limited, revocable, non-transferable, non-sublicensable license to access and use the Service solely for your individual use.
You agree not to:
- Modify, alter, reproduce, or distribute the Service.
- Rent, lease, lend, sell, sublicense, decompile, reverse engineer, disassemble, or create derivative works based on any part of the Service, except to the extent expressly allowed by applicable law.
- Use the Service for time-sharing, service provider, or commercial purposes outside of what is expressly permitted.
Pipe reserves the right to deny access to or terminate the Service at any time, in its sole discretion, without notice or liability, if there is a breach of this EULA.
8. Client Data
Pipe Network is not obligated to screen or monitor client data uploaded or transmitted through the Service. However, Pipe reserves the right to remove any client data it deems in violation of this EULA or applicable law, without notice or liability. Pipe is not responsible for any loss or damage resulting from the removal of client data.
9. Acceptable Use
You agree not to use the Service to:
- Interfere with the proper functioning of the Service, mine cryptocurrencies, or access services that are not publicly available.
- Post or transmit any abusive, defamatory, threatening, or otherwise harmful content.
Pipe reserves the right to suspend or terminate access to any user who engages in prohibited activities.
Prohibited uses include interference with the Service, cryptocurrency mining, and harmful content posting. Violators may be suspended or terminated.
10. Privacy
You may request details of the personal information we hold about you by contacting us at [email protected]. Please refer to our Privacy Policy for additional details on data handling and user privacy.
11. Children’s Privacy
Pipe Network does not knowingly collect information from individuals under the age of 13. If we become aware that we have inadvertently collected information from a user under the age of 13, we will promptly delete such information from our records.
12. Confidentiality
You agree to keep confidential any non-public information provided by Pipe, including technical data, trade secrets, proprietary software, or any other confidential materials (“Confidential Information”). This obligation continues for five (5) years after termination of your access to the Service, or indefinitely for any information classified as a trade secret under applicable law.
13. No Investment Advice
The information provided by Pipe Network does not constitute investment advice, financial advice, or any other form of advice. Pipe Network does not endorse or recommend any financial products or services. Users are encouraged to conduct their own independent research and seek the advice of a licensed financial advisor if needed.
14. Disclaimers and Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. Pipe disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Pipe Foundation, its affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits arising from your use or inability to use the Service. In no event shall Pipe’s total liability exceed the greater of (i) the amount you paid to Pipe, or (ii) $10.
15. Indemnification
You agree to indemnify and hold harmless Pipe Foundation, its affiliates, directors, employees, and agents from any claims, damages, liabilities, and expenses, including reasonable legal fees, arising from your use of the Service or any breach of this EULA.
16. Termination
Pipe reserves the right, at its sole discretion, to terminate or suspend your access to the Service at any time, with or without notice, for any reason, including but not limited to:
- Violation of Terms: Any breach of this EULA, including engaging in prohibited activities or failing to maintain compliance with network requirements.
- Fraudulent Activity: Suspicion or confirmation of fraudulent, deceptive, or harmful actions that compromise the security, integrity, or overall health of the Service.
- High-Risk IP Use: Use of high-risk or unsupported IP addresses, including proxies, data center IPs, or IPs flagged for malicious activity, which may pose a risk to network health.
- Network Integrity Protection: Any actions or behavior deemed by Pipe to threaten the stability, security, or functionality of the network.
Upon termination, you must cease all use of the Service and delete any confidential or proprietary materials provided by Pipe. Termination may involve actions such as blocking specific IP addresses, suspending or deleting accounts, or implementing other necessary security measures.
If your access is terminated or suspended, you are prohibited from attempting to re-register or access the Service under a different name, account, or IP address without express permission from Pipe. Additionally, Pipe reserves the right to investigate any suspected violations or suspicious activity and, if warranted, to take legal action to prevent further risk or harm.
17. Data Collection and Analytics
Pipe may collect usage data and analytics related to your interactions with the Service to improve functionality and performance. By using the Service, you consent to this data collection. Please refer to our Privacy Policy for more information.
18. Governing Law and Arbitration
This EULA is governed by the laws of the Cayman Islands. Any disputes arising from this EULA or your use of the Service shall be resolved through binding arbitration under Cayman Islands law. You waive any right to participate in class actions, and arbitration will be conducted individually.
19. Electronic Communications and Consent
By using the Service, you consent to receive communications from us electronically, including agreements, disclosures, and notices. You agree that all electronic communications satisfy any legal requirement that such communications be in writing.
